Taking Science to Court - Association for Psychological Science

This is a photo of a gavel.Ever since the celebrated submissions to the US Supreme Court regarding segregated education, psychological scientists have made important contributions to legal decision making and public policy development. Recently, psychological scientists have been key witnesses in federal and state courts that are considering challenges to laws restricting the rights of gay and lesbian Americans to raise, foster, and adopt children as well as their rights to have their relationships recognized as marriages.

I became involved in such litigation more than a decade ago, when the American Civil Liberties Union (ACLU) asked me to testify in a case challenging Florida regulations prohibiting gay and lesbian adults from adopting children. The prohibition appeared indefensible from a scientific perspective: There was no evidence that gay and lesbian adults were any less likely to take care of children appropriately and lovingly, but I never had the opportunity to explain the research because a federal judge upheld the prohibition without a trial.

A few years later, however, the ACLU managed to get hearings in both Florida and Arkansas courts challenging these restrictive practices. In both cases, I testified at length about the voluminous body of evidence documenting the factors affecting children?s well-being and adjustment. Specifically, numerous psychological scientists (and other social and behavioral scientists) have shown how the quality of parent?child relationships, the quality of the relationship between the parents (or between parents and other significant figures in their lives), and the adequacy of their economic and social resources are crucially important factors in shaping children?s development. There was no theoretical reason to predict that the parents? sexual orientation was important, and the research on children raised by gay/lesbian parents has consistently shown that such children are just as likely to be well-adjusted as children raised by heterosexual parents.

In both of these early cases, opposing testimony was provided by a clinical psychologist whose credibility was undermined (according to the judges) by an evident religious and ideological bias. Such biases are hardly surprising. With the absence of evidence that adoption by gay/lesbian parents places children at any risk and compelling reasons to believe that many children will remain in state care if not adopted by willing gay/lesbian parents, it is clear that the regulations can only be explained by prejudice. Whereas the Supreme Court of Florida let the lower court ruling stand, thereby overturning the statewide ban, the Arkansas decision prompted changes to the state law that were challenged anew. After a further round of legal maneuvering (and further statements and depositions on my part), the new law was invalidated and Arkansas too began allowing gay and lesbian couples to take care of young children desperately in need of homes and loving caretakers.

By this time, of course, the focus had shifted back to federal courts around the country. Much of the recent litigation has focused on the ways in which the relationships between gay and lesbian adults are legally recognized. While many challenges to laws denying gays and lesbians the right to marry make reference to the literature on factors affecting children?s adjustment, a much broader range of issues has to be addressed. In the most high-profile case to date, a challenge to California?s ban on same-sex marriage, testimony came from historians who chronicled the history of discrimination, sociologists who described the changing cultural landscape, political scientists, and three psychological scientists: APS Fellow Greg Herek (University of California, Davis) discussed the nature and effects of discrimination against gay and lesbian individuals; APS Fellow Letitia Peplau (University of California, Los Angeles) discussed research on the intimate relationships between same-sex adults; and I talked about the factors affecting children?s adjustment, again underscoring that children raised by gay and lesbian parents are just as likely to be well-adjusted as those with heterosexual parents.

Prior to trial, supporters of the ban on same-sex marriage also identified a number of witnesses, all of whom submitted written declarations about which they were deposed (i.e., questioned under oath). Lawyers defending the marriage ban called only two witnesses ? a social commentator and a political scientist ? and the court ruled decisively in favor of overturning the ban on gay/lesbian marriage. That decision was upheld on February 7, 2012, by the US Court of Appeals for the Ninth Circuit, setting up a likely appeal to the Supreme Court.

By the time that case reaches the Supreme Court, however, it may have considerable company. Federal courts around the United States have been hearing challenges to the Defense of Marriage Act (DOMA) of 1996. DOMA denies federal benefits and protections to same-sex partnerships that are otherwise available to married heterosexual couples, even when the same-sex couples are legally married in states where same-sex marriage is permitted. Typically, challenges to federal law would be defended by the Justice Department, but the Obama administration has refused to defend DOMA, so Congress has funded the Bipartisan Legal Advisory Group (BLAG) to do so instead. Again, expert witnesses are playing a central role in these cases; I have been involved in several cases that touch on children?s well-being. As in the case of Perry v. Schwarzenegger (the California marriage case), several appellate court affirmations of lower court decisions striking down elements of DOMA have already been appealed to the Supreme Court. Thus, at some point in the not-too-distant future, the US Supreme Court will again be making a decision about an issue that has been the focus of considerable psychological science research. In Brown v. Board of Education nearly 60 years ago, the body of research was small, but by all accounts, it powerfully swayed the court?s decision. In the gay marriage cases, by contrast, the evidence is extensive and the conclusions are overwhelming. It remains to be seen whether the evidence again plays a decisive role.

WASHINGTON (AP) ? Newly re-elected President Barack Obama will use a White House appearance to set the tone for upcoming talks with congressional Republicans on avoiding the so-called fiscal cliff.

Republicans continue to draw a line in the sand against higher tax rates for upper-income earners as they seek to topple the conventional wisdom that Obama has the upper hand in upcoming negotiations on averting the potentially economy-crippling set of tax increases and automatic spending cuts due to hit in January.

Obama faces a tough, core decision: Does he pick a fight and risk a prolonged impasse with Republicans or does he rush to compromise and risk alienating Democrats still celebrating his victory?

Many of his Democratic allies hope Obama will take a hard line when he addresses the matter Friday. Republicans warn that a fight could poison efforts for a rapprochement in a bitterly divided Capitol and threaten his second-term agenda.

Obama has been silent since his victory speech early Wednesday morning, but Capitol Hill Republicans have filled the vacuum with vows to stand resolutely against any effort by the president to fulfill a campaign promise to raise the top two income tax rates to Clinton-era levels.

"Raising tax rates is unacceptable," House Speaker John Boehner, R-Ohio, declared Thursday on ABC. "Frankly, it couldn't even pass the House. I'm not sure it could pass the Senate."

A lot is at stake. A new Congressional Budget Office report on Thursday predicted that the economy would fall into recession if there is a protracted impasse in Washington and the government falls off the fiscal cliff for the entire year. Though most Capitol-watchers think that a long deadlock is unlikely, the analysts say such a scenario would cause a spike in the jobless rate to 9.1 percent by next fall.

Some analysts believe that the fiscal cliff is more like a fiscal slope and that the economy could weather a short-term expiration of the Bush-era tax cuts and that the government could manage a wave of automatic spending cuts for a few weeks. But at a minimum, going over the fiscal cliff would mean delays in filing taxes and obtaining refunds and would rattle financial markets as the economy struggles to recover.

The CBO analysis says that the cliff ? a combination of automatic tax increases and spending cuts ? would cut the deficit by $503 billion through next September, but that the fiscal austerity would cause the economy to shrink by 0.5 percent next year and cost millions of jobs.

The new study estimates that the nation's gross domestic product would grow by 2.2 percent next year if all Bush-era tax rates were extended and would expand by almost 3 percent if Obama's 2 percentage point payroll tax cut and current jobless benefits for the long-term unemployed were extended as well.

All sides say that they want a deal and that now that the election is over everyone can show more flexibility than in the heat of the campaign.

Obama is not expected to offer specifics immediately. His long-held position ? repeatedly rejected by Republicans ? is that tax rates on family income over $250,000 should jump back up to Clinton-era levels.

Republicans say they're willing to consider new tax revenue but only through drafting a new tax code that lowers rates and eliminates some deductions and wasteful tax breaks. And they're insisting on cuts to Medicare, Medicaid and food stamps, known as entitlement programs in Washington-speak.

The current assumption is that any agreement would be a multistep process that would begin this year with a down payment on the deficit and on action to stave off more than the tax increases and $109 billion in across-the-board cuts to the Pentagon budget and a variety of domestic programs next year.

The initial round is likely to set binding targets on revenue levels and spending cuts, but the details would probably be enacted next year.

While some of that heavy work would be left for next year, a raft of tough decisions would have to be made in the next six weeks. They could include the overall amount of deficit savings and achieving agreement on how much would come from revenue increases and how much would be cut from costly health care programs, the Pentagon and the day-to-day operating budgets of domestic Cabinet agencies.

Democrats are sure to press for a guarantee that tax reform doesn't end up hurting middle-income taxpayers at the expense of upper-bracket earners. Republicans want to press for corporate tax reform and a guarantee that the top rate paid by individuals and small businesses goes down along the way.

VENTURES AFRICA ? In an event graced by sporting heavyweights, both home and abroad, South Africa paid homage to its sport stars who made the country proud this season at the South African Sports Awards held in Sandton, South Africa.

The event attracted politicians like Tokyo Sexwale,??Thabang Makwetla, ?and music icons Sello ?Chicco? Twala, Olera, Lira, PJ Powers, Kelly Khumalo, Sibongile Khumalo, Sipho Mabuse and the Soweto Gospel Choir. ?Also at the event were Tennis stars Serena and Venus Williams.

Winners at the award include 20 years old Chad le Clos, who clinched the sports star of the year ? an award that is decided by public vote. ?Le Clos rose to fame this year after defeating the legendary American swimmer and most decorated Olympian of all time, Michael Phelps by a whisker for the gold medal in the 200 metres butterfly at the 2012 London Olympics.??He also won silver in the 100 metres butterfly behind Phelps.

Le Clos got ?a 1 million rand ($115, 000) cash prize and a BMW sports car as part of the award he clinched.??This is unbelievable?, said Le Clos. ?I never thought I will be celebrating being crowned as a Sport Star of the Year. This has been an incredible year for me. I?ve been training very hard and throughout all my victories, the pressure was there, but I just kept on working very hard.?

?All I want to tell other young South Africans is that they too can achieve more in whatever they do through hard work. I really want to thank South Africans for their overwhelming support,? he added.

Le Clos is now setting his eyes on more gold medals at the next Olympic Games in Rio de Janeiro, Brazil. According to him: ?I want to keep this momentum until the next Olympic Games in 2016 and I believe that through hard work and the support from my coach and the nation, I can do it again,?

?It?s going to be a little difficult for me to do better than this year but I have more goals I want to achieve in swimming ? not just for next year, but for 2016? but? ?With my coach (Graham Hill) and my whole team I believe I can do that. I want to take this momentum and keep swimming on a high but it?s going to be hard.

?It has been an incredible year for me,? he said. ?Looking back to last year, when I got the Newcomer of the Year award, I never thought I would be the Sports Star of the Year.?

Meanwhile, swift bowler Vernon Philander? and Middle-distance runner Caster Semenya, who was second in the Olympic women?s 800m final claimed the title: Sportsman and Sportswoman of the Year respectively. Philander had a prolific debut Test season where he became the second fastest man to take 50 wickets in the history of cricket.

?I?ve had a pretty special 12 months. It?s almost been a dream,? he said.

Oscar Pistorius (athletics) and Natalie Du Toit (swimming) ?were also awarded Sportsman and Sportswoman of the Year with Disability accordingly.

Other winners at the event include: Banyana Banyana?s Joseph Mkhonza (coach of the Year); Federation of the year: rowing; Siya Kolisi (Rugby) ? Newcomer of the year; Sondiso Magajana (judo) ? Volunteer of the year; Velile Mbuli (Sport Journalist of the year); Sydney Seshibedi (Photographer of the year); Vakhegula Football (Recreation body of the year) and Ithembelihle High (rugby) for the School Team of the year.

The Rowing Sport Federation of South Africa was one of the biggest winners. President Wimpie du Plessis swooped the administrator of the year award; Olympic gold medal-winning South African men?s coxless lightweight fours rowing team of Sizwe Ndlovu, Matthew Britain, John Smith and James Thompson also walked away with the team of the year award.

In this case, both phones work with Pandora. The iPhone connects with its 30-pin dock connector while Android does it through Bluetooth. But to settle the matter, iPhone wins the match by having more company brands with cars only compatible to its connector.

Key US ally Bahrain strips dissenters of citizenship

Bahrain?s government said Wednesday that it had revoked the citizenship of 31 Bahrainis, described by human rights activists as mostly former political detainees.

Two human rights groups, the Bahrain Center for Human Rights and the Bahrain Youth Society for Human Rights, issued a joint statement expressing their ?grave concern over the systematic targeting of prominent political activists, former members of parliament, clerics and others.?

They called on the United States, U.K., United Nations and others to put pressure on the Bahraini authorities to reverse the decision and allow freedom of expression, and also to ?immediately stop the systematic and widespread human-rights violations.?

'Damage to state security'
Bahrain, a small island kingdom, is an important ally of the United States as it is home to the U.S. Navy's Fifth Fleet. There has been significant unrest since?pro-democracy protests erupted last year as the Arab Spring movement swept the region.

The Bahrain News Agency published a brief statement by the Ministry of Interior that cited a law allowing ?the re-evaluation of nationality when a holder of the Bahraini citizenship causes damage to state security.?

It then listed names of 31 people whose citizenship had been revoked, including Ali Hassan?Mushaima, the son of?the leader of the Haq movement, Hassan?Mushaima, who is serving a life sentence.

?The Minister of Interior will take the necessary measures to implement this in conformity with the kingdom's commitments under international law,? the statement added, saying the people named would be able to appeal.

The human rights groups? statement said the authorities had not provided ?substantial evidence? explaining the decisions.

?It is apparent that the actions taken by the Bahraini authorities to revoke the citizenships of 31 individuals is intended to punish them for expressing peaceful dissent and thereby intimidate others from exercising their right to freedom of expression,? it said. ?This comes at a time when the crackdown in Bahrain by the authorities is intensifying, and in light of continued international inaction, will continue to deteriorate.?

Mohammed al-Maskati, president of the Bahrain Youth Society for Human Rights, told NBC News that about 70 percent of the people on the list were former political detainees.

Some on the list are living abroad with at least eight in the U.K., and others in Iran, Iraq, Sweden and Australia. Some of those have been granted political asylum by other countries, al-Maskati said.

Security forces fire tear gas as they crackdown on pro-democracy demonstrators who have vowed to disrupt the race. Bahrain's monarchy is desperate to show the world that the country is a safe place for the race.

For those living in Bahrain, al-Maskati said the effects of withdrawal of citizenship would likely be serious.

He said they would not be able to access education, private or public health care, or receive government benefits. He added that this would also apply to the men?s wives and children.

?If you don?t have a passport, you don?t have a national ID; if you don?t have a national ID, you cannot do anything in Bahrain,? al-Maskati said.

Bahrain breaks up anniversary protest, deports US activists

He said it remained to be seen what the legal status of the men would be.

?We don?t know what action they will take against them, if they will ask them to leave the country or they will let them ? take their case to the courts. We don?t know what legal status they will find themselves in now.?

However, he noted that the official statement said that the people concerned would be able to appeal.

Article 15 of the Universal Declaration of Human Rights says that ?everyone has the right to a nationality,? and ?no one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.?

In a separate statement, the Bahrain Center for Human Rights said it was concern at reports that a detainee, Adnan Al-Mansi, 22, had been subjected to ?severe physical torture, including sexual assaults? after his arrest.

The center said al-Mansi had been accused of making a bomb, but it said he was ?a prisoner of conscience detained solely on the basis of his political opinion.?

NBC News requested a comment from the Bahrain Embassy in the U.K., but a response was not immediately received.

Springsteen: 'A world that challenges hopefulness'

MADISON, Wis. (AP) ? Rock legend Bruce Springsteen is joining President Barack Obama at a rally in Wisconsin, playing the anthem "Land of Hope and Dreams." He says that after Obama ran with an optimistic message of change in 2008 he now faces "a world that challenges your hopefulness."

Springsteen was spending Obama's final day of campaigning with the president, traveling with him on Air Force One and opening rallies for him in Madison, Wis.; Columbus, Ohio; and Des Moines, Iowa.

Springsteen's appearance came a day after Stevie Wonder energized a Cincinnati rally for Obama, prompting the president to do a brief shimmy on the stage to "Signed, Sealed and Delivered."

Springsteen jokes that while he's proud to be endorsing the president again, "that first debate really freaked me out."

Danny Boyle opposes plan to sell Moore sculpture

LONDON (AP) ? Director Danny Boyle has joined leading British arts figures urging a cash-strapped local authority not to sell off a valuable Henry Moore sculpture ? arguing it should be erected in London's Olympic Park instead.

"Draped Seated Woman" is owned by London's Tower Hamlets Council and stood for years on a public housing complex in the city's East End.

Last month the council announced plans to sell the bronze artwork to offset funding cuts. Estimates of its value range from 5 million pounds to 20 million pounds ($8 million to $32 million).

Tower Hamlets Mayor Luthur Rahman said the local authority faced a "stark choice" at a time of economic weakness and government austerity.

Moore, who died in 1986, is one of Britain's best-known 20th-century artists, and his curved, semi-abstract forms stand in public spaces around the world.

He sold "Draped Seated Woman" to the now-defunct London County Council in 1960 for a token price so it could enrich the lives of residents in a poor area.

During its years in the East End it became known locally as "Old Flo" and was regularly vandalized.

When the housing project was demolished in the late 1990s, the work was moved to the Yorkshire Sculpture Park in northern England.

The proposal to sell it has sparked a campaign to return the artwork to east London, a vibrant but poverty-scarred area that hosted this summer's Olympic Games.

Boyle, artists Jeremy Deller and Rachel Whiteread, Tate galleries director Nicholas Serota and the sculptor's daughter Mary Moore are among signatories to a letter asking the council to reconsider.

Boyle, who won an Academy Award for "Slumdog Millionaire" and directed the opening ceremony of the Olympics, said Monday that the sculpture "defies all prejudice in people's minds about one of London's poorest boroughs."

"That alone makes it priceless to every resident," he said. "Let's put it in the Olympic Park alongside the Bradley Wiggins Bell" ? rung by the British cycling champion to mark the opening of the games.

The Museum of London also has offered to display the sculpture.

The council is due to decide on the work's fate on Wednesday.

Passengers Love The New Boeing 787 Dreamliner - Business Insider

ABOARD UA1116 -- -- In a trip years in the making, United Airlines passengers Sunday got their first chance to experience the Boeing 787 Dreamliner, which made its inaugural voyage for the airline on a scheduled flight from Houston to Chicago.

The twin-aisle plane, which made its debut three years late because of production problems at Boeing, is said to be far more fuel efficient and less costly to maintain, while offering a new level of in-cabin comfort for passengers. Instead of being made mostly of metal, half the plane, including the fuselage and wings, is made of strong, light composite materials.

"If you want to be the world's leading airline, you need to have the world's leading airplane, and we have that today in the new Boeing 787 Dreamliner," said United CEO Jeff Smisek, who said he hadn't flown on one until the flight to O'Hare International Airport. "It's been a long haul to get here."

United is the first North American airline to receive a 787.

Sunday's flight was a big deal for airline enthusiasts and for the two companies, United Continental Holdings and Boeing Co., whose headquarters are a few blocks apart in downtown Chicago and which once were part of the same company.

Michael Phillips, 38, a meteorologist from New Jersey, spent $1,900 to fly first-class on four legs on the 787, starting with the Houston-Chicago segment. "It was a great flight," he said after landing in Chicago. "It was a very quiet cabin. The quietness really stood out for me."

He also liked the tall cabin ceilings. "It was like I could jump up and not hit my head on the ceiling," he said.

Phillips also found several "hidden gems," like the way the air nozzles worked, the functionality of the seat-back entertainment system and the hands-free fixtures of the bathroom, like the faucets. He said he was impressed by the lavatory doors, which rotate inward, away from people in the aisle.

"It was not a very airplane-y experience," he said.

The flight was important for United, which has had a rough year, with widespread delays and cancellations after a reservations system switch in March and intermittent strife with its unions, especially pilots -- though both of those problems have abated in recent weeks. The airline is still working through merger hassles, months after United and Continental finished combining operations.

Some observers say the halo effect of being the first North American carrier to fly the Dreamliner is a much-needed boost to the reputation of the world's largest airline. More tangibly, the plane is more fuel efficient than planes it will replace -- Boeing claims 20 percent more efficient for some replacements. Fuel is a huge cost for airlines, so that's savings that can fall to the bottom line for United.

For Boeing, Sunday's flight represents another step toward repairing its reputation surrounding the 787, which started deliveries more than three years late because of design and production problems. The near-constant delays were so rampant the plane earned the nickname 7-late-7.

However, Boeing may have the last laugh. Dreamliners have sold like hot cakes, and early reviews are glowing from customers who have flown the plane on foreign airlines over the past year and from those who flew from Houston to Chicago on Sunday.

Aviation enthusiast Thomas Lee, of Orange County, Calif., flew the inaugural flights of the Boeing 747, the first wide-body commercial aircraft; the Airbus 380, the first full-length double-decker plane; and the 787, the first plane with a largely composite structure.

"It's incredibly exciting," Lee said.

Aaron Gellman, professor of transportation at the Kellogg School of Management at Northwestern University, agreed.

"It's a big deal for United and Boeing and, absolutely, for consumers," Gellman said. "I think it's well on its way to meeting all its guarantees."

Aviation analysts had their criticisms, however.

"The plane is more a game-changer for United and the airlines that run the 787 than it is for passengers," said Henry Harteveldt, co-founder of Atmosphere Research Group. "Only the most frequent of fliers will really notice and care about this."

For example, people care about their seat space, and United chose to install nine seats across in economy class, instead of eight, as Boeing envisioned and other 787 owners, like All Nippon Airways, use.

"It will be a nice plane, but it's not going to blow anyone's socks off, unfortunately," Harteveldt said. "Boeing has done everything it can, but the so-called last mile that could really make passengers go 'wow' and develop newfound respect for United? United has failed to do anything in its power that will impress the customer."

Why did United choose to install nine seats across in coach?

"It's really a revenue decision," Smisek said. "It also, candidly, allows us to charge fares that are otherwise lower than we would have to charge if we had fewer seats."

Another obvious omission onboard was wireless Internet access, which is becoming standard on mainline planes. Smisek said the plane, because it was ordered in 2004 when Wi-Fi wasn't available, isn't certified for it. "As soon as it's certified for Wi-Fi, we'll retrofit for Wi-Fi. That will probably be sometime in 2014," he said.

Richard Aboulafia, vice president of analysis at Teal Group, agrees that United could have done more to make the plane outstanding. But, he said, the Dreamliner will help connect more international cities without a need for a connecting flight.

"Anything that allows more direct flights without having to change in major hubs is certainly welcome," Aboulafia said.

After using the 787 temporarily on domestic routes, United plans to use the first Dreamliners on international routes. United expects to receive five Dreamliners before the end of the year and has a total of 50 on order from Boeing.

"It's living up to all the expectations," Smisek said. "It's a tremendous airplane for us to operate, and it's a great experience for our customers."

Cheniere Reports Net Loss of USD 109 Million

Cheniere Energy reported a net loss of $109.0 million for the three months ended September 30, compared to a net loss of $53.9 million for the comparable 2011 period.

For the nine months ended September 30, Cheniere reported a net loss of $238.5 million, compared to a net loss of $140.9 million during the comparable 2011 period.

For the three months ended September 30 results include significant items of $23.8 million, related to other expenses that primarily consisted of the write-down of a royalty interest and to liquefied natural gas (LNG) terminal and pipeline development expenses primarily for the liquefaction facilities Cheniere Energy Partners is developing and constructing adjacent to the Sabine Pass LNG terminal.

For the nine months ended September 30, results include significant items of $81.2 million, related to LNG terminal and pipeline development expenses for the Sabine Pass Liquefaction Project, losses due to the early extinguishment of debt, and other expenses that primarily consisted of the write-down of a royalty interest.

Results for the three and nine months ended September 30 were also impacted by increases in general and administrative expenses of $63.2 million and $63.1 million, respectively, compared to the comparable 2011 periods primarily due to the August 2012 vesting of awards under the long-term incentive plan related to LNG trains 1 and 2 of the Sabine Pass Liquefaction Project.

Cheniere recorded non-cash compensation expense of $49.8 million and $54.0 million, respectively, for the three and nine months ended September 30, compared to $2.3 million and $16.6 million for the comparable periods in 2011.

These increases were partially offset by a decrease in interest expense of $19.6 million and $34.1 million, respectively, as compared to the comparable 2011 periods.

Scientists monitor comet breakup

ScienceDaily (Nov. 4, 2012) ? The Hergenrother comet is currently traversing the inner-solar system. Amateur and professional astronomers alike have been following the icy-dirt ball over the past several weeks as it has been generating a series of impressive outbursts of cometary-dust material. Now comes word that the comet's nucleus has taken the next step in its fragmentation.

"Comet Hergenrother is splitting apart," said Rachel Stevenson, a post-doctoral fellow working at NASA's Jet Propulsion Laboratory in Pasadena, Calif. "Using the National Optical Astronomy Observatory's Gemini North Telescope on top of Mauna Kea, Hawaii, we have resolved that the nucleus of the comet has separated into at least four distinct pieces resulting in a large increase in dust material in its coma."

With more material to reflect the sun's rays, the comet's coma has brightened considerably.

"The comet fragments are considerably fainter than the nucleus," said James Bauer, the deputy principal investigator for NASA's NEOWISE mission, from the California Institute of Technology. "This is suggestive of chunks of material being ejected from the surface."

The comet's fragmentation event was initially detected on Oct. 26 by a team of astronomers from the Remanzacco Observatory, using the Faulkes Telescope North in Haleakala, Hawaii. The initial fragment was also imaged by the WIYN telescope group at Kitt Peak National Observatory in Arizona.

For those interested in viewing Hergenrother, with a larger-sized telescope and a dark sky, the comet can be seen in between the constellations of Andromeda and Lacerta.

The orbit of comet 168P/Hergenrother comet is well understood. The comet, nor any of its fragments, are a threat to Earth.

Big Tech Companies Challenge Spotify - hypebot

It?s no simple matter to make music fans happy enough to pay $10 per month, even for unlimited access to most of the music in the world, while also paying royalties to record labels, music publishers, and artists. As another indication of just how tricky that balancing act really is, one of the leading services ? MOG ? sold to a celebrity headphone company for a mere $14 million. By comparison, Spotify?s market cap is reported to be about $4 billion ? 286 times what MOG was worth to headphone kings Beats Audio.

The leading online radio service, Pandora, lobbies Congress to ease up on the royalty rates it has to pay SoundExchange, and other than Clear Channel?s iHeartRadio, it doesn?t seem to have much in the way of competition for the online radio market ? a sign that some take that ?the rent?s too damn high,? so to speak, for internet radio.

However, the situation couldn?t be more different in the other half of the digital distribution market: the unlimited, on-demand music services. Spotify has the lead, but Deezer?s been crushing it in many areas of the world, and just scored major funding of its own ($130 million, says The Next Web). Meanwhile, Rdio, MOG, and Rhapsody continue to entertain loyal fans.

Now, the bigger players are getting in on the fun. Yes, unlimited, on-demand music is heating up, after countless earlier subscriptions failed. Massive, multinational corporations are getting in on the unlimited music business, in part as a strategy for making their hardware more attractive ? sort of like Apple did with iTunes.

Just about every major technology brand is trying to pull an Apple right now, by launching their own end-to-end music ecosystems? even if it means losing money. As the head of Microsoft Xbox Music told us in a Manhattan meeting earlier this month, unlimited music could become a sort of loss leader for all kinds of other companies ? assuming they can create something that works as well as Spotify and the other ?pure play? music services.

In part, this resurgence is happening because the DRM that enables music subscriptions is now invisible to the consumer ? a massive shift whose full impact has yet to be felt.

Microsoft: Eager to put its ?Zune-doggle? behind it, the Redmond Giant is doubling down on Xbox Music across not only its multi-purpose gaming console, but on Windows Phone 8, Windows 8, and Windows RT tablets. If you play a music file on any of these devices, the player that launches automatically has over 18 million other tracks, free for the playing.

Rara (Omnifone): This Omnifone-backed newcomer hopes to make a dent in the market by forgoing the freemium concept in lieu of a $1/month trial. It recently rolled out an iOS app as well.

Samsung: The Korean juggernaut snapped up mSpot in order to launch its own unlimited music service, Samsung Music Hub, which combines a locker, download store, and streaming radio service with unlimited music.

Sony: The company that brought the world portable music only to miss out on digital music completely is giving it another another shot with Sony Music Unlimited. Whereas Sony used to sell downloads that only its weird hardware players could play, the company has wised up, and offers its unlimited music on iOS and Android.

Will these big players make a dent in a market so far dominated by start-ups? We shall see. They certainly have the deep pockets and bundling options to give it a good shot? unless the internet only wants one of everything.

(AP) ? Norv Turner is off the hot seat, at least for 10 days.

Romeo Crennel is perched squarely on it.

Antonio Gates caught a 14-yard yard scoring pass from Philip Rivers on the game's opening drive to snap a streak of six straight quarters without a touchdown and the San Diego Chargers went on to a 31-13 victory over the staggering Kansas City Chiefs on Thursday night.

Turner had been heavily criticized by fans after the Chargers (4-4) blew double-digit, second-half leads in losses to New Orleans and Denver, and then lost 7-6 at Cleveland on Sunday.

Still, at the start of halftime, some fans in one end zone unfurled a big yellow banner that read: "Mr. Spanos, please fire A.J. & Norv."

Team president Dean Spanos decided in January to bring back both Turner and general manager A.J. Smith even though the Chargers missed the playoffs for the second straight year and have only one postseason win in four seasons.

Spanos probably isn't inclined to fire the embattled Turner in midseason, although a loss to the Chiefs would have been embarrassing.

"We didn't talk about it specifically, but we want to win for him every week," Rivers said. "You play for a lot of things, but we play for our coach. I think that has been evident over the years when we have struggled."

Rivers, who looked shaky during the losing streak, did his part by completing 18 of 20 passes, or 90 percent, for 220 yards and two touchdowns, with one interception. It was the sixth time in NFL history a quarterback had completed 90 percent or more of his passes, and tied Steve Young for fifth on that list.

Rivers also threw a 13-yard TD pass to Malcom Floyd early in the fourth quarter.

"It was good to play well but more importantly, it was good to win a game. We needed a win in the worst way," Rivers said. "Game like this, wins like this can jump start us."

The Chiefs (1-7) committed four more turnovers and lost their fifth straight game. Running back Jamaal Charles left with a neck injury in the fourth quarter.

"Similar to what's been happening throughout the course of this year, we shoot ourselves in the foot," Crennel said. "We're in a hole and we have to fight our way out. ... It wasn't very good overall, but we're going to keep coaching and keep fighting and play our way out of it."

The Chiefs' four turnovers ran their NFL-high mark to a staggering 29, which have led to 104 points.

"We fought hard, played hard, but at the end of the game it came down to the turnovers," said quarterback Matt Cassel, whose fumble and interception both led to a Chargers TD.

The Chiefs still haven't led in regulation this season. Their only victory came when Ryan Succop kicked the winning field goal against the Saints in overtime.

With the Chiefs trailing 17-6, Cassel fumbled as he was sacked by Jarret Johnson in the end zone and Shaun Phillips recovered for a touchdown early in the fourth quarter. On the next drive, Cassel's high pass deflected off Dexter McCluster's hands and was intercepted by Demorrio Williams, who returned it 59 yards for a touchdown.

"I don't know If someone stepped in front of him and tipped the ball but thank God I was there to make the play," Williams said.

In the loss to New Orleans, Williams had an interception return for a touchdown but it was nullified after rookie Melvin Ingram was flagged for a late hit on Drew Brees.

Williams, who played for the Chiefs the last four seasons, forced a fumble in the first quarter.

The Chiefs had six turnovers in a 37-20 home loss to the Chargers on Sept. 30.

In just 2 minutes, 9 seconds, the Chargers' defense scored as many touchdowns as the offense has in 10 quarters.

Gates' first-quarter score was San Diego's first touchdown since the star tight end caught an 11-yard pass in the first half against Denver on Oct. 15. That score gave San Diego a 24-0 lead, but Peyton Manning rallied the Broncos to a 35-24 win.

The Chargers got only two field goals from Nick Novak in a 7-6 loss at Cleveland on Sunday, their third straight defeat.

After San Diego scored on the opening drive, Kansas City went on a 17-play drive, converting four third downs, but Dwayne Bowe fumbled after a 10-yard reception. Williams caused the fumble and Quentin Jammer recovered.

Bowe's fumble set up Novak's 25-yard field goal with 9:10 left in the second quarter.

After Kansas City decided not to go for it on fourth-and-1 from the San Diego 31, Succop kicked a 49-yard field goal with 2:51 left before halftime.

The Chargers had a third-and-goal from the 1 in the closing seconds of the half when Rivers was intercepted by Eric Berry.

Succop had a 41-yard field goal in the third quarter.

NOTES: Charles was hurt when he was hit in the side of the head by Donald Butler. He said he would have gone back in, "but they told me to just relax." Charles said he was tested for a concussion but was cleared. ... San Diego's Ryan Mathews appeared to sprain his left ankle early in the second quarter and was in and out of the game after that. ... Pfizer has retracted a 2009 Journal of Clinical Oncology study purporting to show a benefit of their experimental drug for lung cancer figitumumab after discovering that its clinical lead on the project had done analyses improperly.

Here?s the text of the notice:

Pfizer, Inc., has recently learned that the overall response rate and progression-free survival data published in ?Phase II Study of the Anti?Insulin-Like Growth Factor Type 1 Receptor Antibody CP-751,871 in Combination With Paclitaxel and Carboplatin in Previously Untreated, Locally Advanced, or Metastatic Non-Small-Cell Lung Cancer? (J Clin Oncol 27:2516-2522, 2009) are incorrect. These results, which have no impact on the safety profile of figitumumab, were discovered by Pfizer researchers during routine study close-out activities.

Specifically, in some cases, responses were not confirmed by performing a 4-week follow-up computed tomography scan per RECIST, or the follow-up scan did not verify continued tumor shrinkage. In addition, the response rate may have been overestimated as a result of including both confirmed and unconfirmed responses in the analysis. These errors in the objective response rates and progression-free survival data appear to be the result of inaccurate clinical data analyses that were performed outside of Pfizer?s standard operating procedures and are not the result of problems arising from study conduct. The revised data, included in the table below, were obtained through strict application of RECIST criteria and assignment of patients to a dosing level on the basis of original treatment received.

Because these results are fundamental to the conclusions of the paper, Pfizer and the lead author, Daniel D. Karp, MD, respectfully request that this article be retracted. We have shared the proposed retraction notice with all of the authors, and all agreed with this retraction notice. Pfizer has no reason to believe that the external authors contributed to the publication of these incorrect data and deeply regrets the impact of this action on the work of other investigators and to the readers of Journal of Clinical Oncology.

In a table included in the notice, there?s a clear difference in the results before and after the corrected analysis. In the original paper, for example, the control group, who received standard lung cancer treatments paclitaxel and carboplatin, had a median progression-free survival of about 3.5 months, while those who had the highest dose of CP-751,871 had a median of 5.0 months without progression. In the new analysis, there was no statistically significant difference between those two groups, with the control at 4.3 months and the high-dose group at 4.5 months.

Pfizer tells Retraction Watch that the study

?demonstrated that figitumumab was likely to be effective when used in combination with two chemotherapy drugs, paclitaxel and carboplatin, in patients with NSCLC; but not to the same degree as the previously published results indicated. ?The study did not demonstrate that the combination of the drugs was effective in the studied subset of patients with non-adenocarcinoma.

CP-751,871 is also known as figitumumab, which, as the company explains,

is a Pfizer-discovered monoclonal antibody that was developed for the treatment of various forms of cancer, including lung, prostate, breast and colorectal cancers and Ewing?s sarcoma.

The company stopped developing the drug in January 2011 after two Phase 3 studies in non-small-cell lung cancer (NSCLC) failed. The first of those trials ended in December 2009 after ?independent monitors had found more serious adverse events, including deaths, with patients receiving figitumumab,? Reuters reported at the time. (The company stopped enrolling new patients in October of that year.) Pfizer is ?no longer seeking regulatory approval for this compound.?

The 2009 JCO study has been cited 152 times, according to Google Scholar.

Pfizer gave Retraction Watch a bit more detail on what happened, including the fact that their clinical lead on the compound has left the company:

While conducting study close-out activities, Pfizer became aware that final data from a Phase 2 study of figitumumab, known as the 1002 study, and certain biomarker analyses performed in connection with the figitumumab program differed from the results that had been reported previously to regulators and published in medical journals.

We conducted a thorough and comprehensive review to determine how this may have occurred, and enlisted the services of independent experts to assist with this review. ?Our review determined that these errors were the result of inaccurately performed clinical data analyses. ?These incorrect analyses were performed outside of Pfizer?s standard operating procedures by the clinical lead, who left the Company in September 2010. ?The problems were not based on study conduct or the work of the external investigators.

The clinical lead on the project appears to have been Antonio Gualberto, who is listed as a faculty member at Brown University?s medical school but does not appear to be employed there anymore, as his email bounces.

Pfizer continued:

Patient health and safety is our first concern. ?We want you to know that these new findings do not alter the safety profile of figitumumab.

Since Pfizer learned of these issues, we have been carefully analyzing our internal controls and ensuring that issues such as these did not exist in any other development programs. ?Our internal review has confirmed that this was an isolated incident and the controls in place at that time were rigorous.

We are committed to ensuring that accurate clinical study results are disclosed to medical professionals, patients and the public.? As per our standard practice, we are making the final study results available in a timely and responsible manner.

After delays, American offers fliers double miles

DALLAS --?American Airlines is offering double-mile promotions as a way of apologizing for recent delays and cancellations.

The airline announced the offer under its AAdvantage program on Friday. One will run through Dec. 31, the other around Thanksgiving.

"Our recent operating performance was not up to our standards ... and for that, we are deeply sorry," Suzanne L. Rubin, president of the airline's AAdvantage frequent-flier program, said in a message to customers.

In September, American canceled nearly 1,400 flights, and only 59 percent of its flights arrived on time compared with at least 85 percent at rivals Delta, Southwest and US Airways, according to tracking service FlightStats.com. The airline, which imposed pay and benefit cuts for pilots in early September, accused some pilots of conducting an illegal work slowdown.

American announced two offers:

  • Elite-level customers, who start at 25,000 miles in a year, will get double miles through Dec. 31.
  • Other passengers will get double miles from Nov. 16 through Nov. 26.
  • Both groups can get double credit toward elite status on flights through the end of the year.

The offers cover flights on American and regional affiliates American Eagle and American Connection but not flights operated by so-called code-sharing partner airlines.
